Requesting Rehabilitation

When you are convicted by a criminal court, that conviction appears on your criminal record. However, having a criminal record can significantly hinder your job search, for example. To prevent a conviction from continuing to haunt you, you can request rehabilitation. Note, however, that rehabilitation does not remove the convictions from your criminal record. It does allow you to obtain a blank certificate of good conduct and morals.

With a rehabilitation petition, you can clear your criminal record. How do you request rehabilitation? We assist with drafting a rehabilitation petition. To submit a rehabilitation request, certain documents are required for the file. Together, we will determine which documents you need and where the application must be submitted.

To obtain a restoration of honor and rights, you must meet several conditions:

  • You must have served the imposed prison sentence and/or paid the imposed fine and fulfilled the obligation for restitution, compensation, and payment of costs as determined in the verdict. If the sentence can no longer be executed due to the statute of limitations, this must not be your fault.
  • You must not have previously obtained a rehabilitation in the past 10 years.
    Additionally, you must undergo a probationary period, which can range from 3 to 10 years depending on the nature of the sentence and the facts for which you are requesting rehabilitation.
