What is Mediation?
Mediation is a way to resolve disputes and discussions outside of court. When two or more parties have a conflict they cannot resolve themselves, they can turn to a mediator.
The mediator is a neutral third party who helps the parties find a solution. They are independent and will not act on behalf of or fight for just one of the parties. It is always better for parties to reach a solution together through dialogue with each other rather than through a procedure against each other.
What are the steps of mediation?
Initial introduction: Explanation of the mediation process and its course. Discussion of your concerns and expectations. Answers to pressing questions.
Discussion of protocol: Together, we discuss the rules and legal obligations of a mediation process.
Developing a plan of action: Your concerns are turned into an action plan. Deciding on which points an agreement can be reached.
Mediation sessions: The action plan is implemented during our discussions. We inform, support, and mediate between the parties.
Drafting a tailored agreement: The reached agreements are documented in writing and compiled into a detailed contract.
Court and/or notary involvement: In some cases, the intervention of a notary and/or court is necessary or advisable. For example, in a divorce or the transfer of real estate.
Post-mediation review: Are there still further questions? Then we provide space for a follow-up discussion.
